Unified Terms of Service, Privacy Policy & Data Protection Agreement

1. Acceptance of Agreement
By accessing or using any website, music, game, application, merchandise, donation platform, or digital property operated by Red Flame Legacy Ministry (“Ministry”), you enter into a legally binding agreement. Electronic use constitutes binding assent. If you do not agree, discontinue use immediately. Users under 18 require parental consent.
2. Scope
This Agreement governs all Ministry properties including websites, music recordings, streaming content, games (including Kids World), educational systems, books, publications, branding, code, digital architecture, merchandise, and donation systems.
3. Intellectual Property
All content is protected under U.S. and international law including the U.S. Copyright Act, Berne Convention, and WIPO treaties. Copyright attaches upon creation. No license is granted beyond personal, non-commercial use.
The visual layout, color scheme, navigation systems, and overall interface constitute protected trade dress. Unauthorized imitation is prohibited.
4. Music Rights and ISRC Enforcement
All master recordings are assigned ISRC codes for global identification and tracking. Unauthorized uploading, monetization, redistribution, metadata tampering, re-registration, or derivative use constitutes infringement. Each unauthorized upload may be treated as a separate violation.
5. Prohibited Activities
You may not reverse engineer code, scrape databases, clone systems, extract content, monetize Ministry materials, or create derivative works without written consent.
Prohibited AI uses include dataset harvesting, large language model training, voice cloning, style replication systems, neural embedding extraction, generative model training, or automated scraping for machine learning purposes.
6. Enforcement and Remedies
Unauthorized use may result in injunctive relief, removal actions, statutory damages where applicable, actual damages, and recovery of attorney fees where permitted by law.
7. Merchandise and Product Liability
All merchandise is provided “AS IS.” Liability is limited to replacement of the defective item or refund of purchase price at Ministry discretion. The Ministry is not liable for allergic reactions, misuse, or incidental damages.
8. Refund Policy
All sales are final unless otherwise required by law. Manufacturing defects must be reported within 48 hours of delivery.
9. Shipping Policy
Risk of loss transfers upon delivery to carrier. The Ministry is not responsible for lost, stolen, or delayed shipments.
10. Donations
Donations are voluntary gifts and are non-refundable except where required by law. Donations do not grant ownership or control.
11. Privacy Policy
We may collect name, email, IP address, device data, donation information, usage analytics, and communication submissions. We do not sell personal data. Data is used for service delivery, security, and communication.
12. Data Security
We implement commercially reasonable safeguards. No system is 100% secure. You acknowledge inherent digital risks.
13. GDPR Compliance (EU)
EEA users have rights to access, rectification, erasure, restriction, portability, objection, and withdrawal of consent. Data transfers outside the EU occur under lawful safeguards.
14. CCPA / CPRA (California)
California residents may request disclosure, deletion, or correction of personal information. We do not sell personal data.
15. Children’s Privacy
We do not knowingly collect personal information from children under 13 without parental consent.
16. International Users
Users outside the United States consent to data processing in the U.S. and application of U.S. intellectual property laws.
17. Disclaimer of Warranties
All services are provided “AS IS” and “AS AVAILABLE.” No warranties are made regarding availability, security, compatibility, or outcomes.
18. Limitation of Liability
To the fullest extent permitted by law, total aggregate liability shall not exceed the greater of USD $100 or the total amount donated or spent by you in the preceding 12 months.
This limitation of liability forms an essential basis of the agreement, and access would not be granted without it.
19. Assumption of Risk
You voluntarily assume all risks associated with digital usage, streaming, merchandise, and online interactions.
20. Mandatory Binding Arbitration
All disputes shall be resolved exclusively by binding arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules. Arbitration shall occur in Alabama before a single neutral arbitrator. You waive the right to a jury trial. Either party may bring an individual claim in small claims court if eligible.
21. Class Action Waiver
Claims must be brought individually. No class, consolidated, or representative proceedings are permitted.
22. Exclusive Venue
If arbitration does not apply, exclusive jurisdiction lies in Alabama state or federal courts.
23. DMCA Policy
Formal infringement notices must include legal name, description of work, exact URL, contact information, statement under penalty of perjury, and signature. False notices may result in liability.
24. Indemnification
You agree to indemnify and hold harmless the Ministry from claims arising from misuse or violation of this Agreement.
25. Time Limit on Claims
Any claim must be filed within one year or it is permanently barred.
26. Force Majeure
The Ministry is not liable for failures caused by events beyond reasonable control including natural disasters, cyber attacks, hosting failures, governmental actions, or platform outages.
27. Third-Party Platform Dependency
The Ministry is not responsible for platform outages, demonetization, algorithm changes, or policy decisions made by third-party services.
28. Payment Processor Disclaimer
Payments are processed through third-party providers. The Ministry does not store full credit card information and is not liable for security incidents within third-party systems.
29. Modification of Terms
The Ministry may update this Agreement at any time. Continued use constitutes acceptance of revisions.
30. Survival of Obligations
Intellectual property rights, arbitration provisions, liability limits, indemnification, and time limitations survive termination of access.
31. Severability
If any provision is unenforceable, remaining provisions remain valid.
32. Entire Agreement
This Agreement constitutes the entire agreement between you and Red Flame Legacy Ministry.

Final Legal Provisions
Binding Effect
By accessing or using any Ministry property, you affirm that you have read, understood, and agreed to this Agreement in full. Continued use constitutes ongoing acceptance.
Modification of Terms
The Ministry reserves the right to update or modify this Agreement at any time. Updates become effective immediately upon posting. Continued use after changes constitutes acceptance of revised terms.
Governing Law
This Agreement shall be governed by and construed in accordance with the laws of the State of Alabama, United States, without regard to conflict of law principles.
Mandatory Binding Arbitration
Any dispute arising out of or relating to this Agreement shall be resolved exclusively by binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. Arbitration shall take place in Alabama before a single neutral arbitrator. You waive the right to a jury trial.
